Article 1 — Applicability and Legal Framework

  1. These Terms and Conditions apply to all offers and distance contracts concluded between Duckie Wonderland and consumers.
  2. These Terms apply exclusively to consumers (B2C).
  3. These Terms are drafted in accordance with Directive 2011/83/EU on Consumer Rights and applicable Dutch consumer protection legislation.
  4. Where mandatory consumer protection laws in the consumer's country of residence apply pursuant to Regulation (EC) No 593/2008 (Rome I), such mandatory provisions shall prevail.
  5. If any provision is declared invalid, the remaining provisions shall remain fully in force.

Article 2 — The Offer

  1. The offer contains a complete and accurate description of the products offered.
  2. Obvious errors or mistakes do not bind Duckie Wonderland.
  3. Images and colors may vary due to screen settings or production variations.
  4. Limited editions are available while stocks last.
  5. If a product is unavailable after purchase, the consumer will be informed promptly and the amount paid will be refunded.

Article 3 — Conclusion of the Agreement

  1. The agreement is concluded when the consumer accepts the offer and completes the order process.
  2. An electronic confirmation will be sent without undue delay.
  3. Duckie Wonderland reserves the right to refuse orders in case of suspected fraud, misuse, or incorrect information.

Article 4 — Prices and Payment

  1. All prices include VAT.
  2. Shipping costs are clearly stated before concluding the agreement.
  3. Payment must be completed via the available payment methods.
  4. Orders are processed only after full payment has been received.
  5. In case of unjustified chargebacks or fraudulent payment behavior, Duckie Wonderland reserves the right to pursue legal remedies.

Article 5 — Delivery and International Shipping

  1. Duckie Wonderland ships worldwide.
  2. Delivery times are indicative and do not constitute a strict deadline.
  3. Risk transfers to the consumer at the moment of physical delivery.
  4. Import duties, customs charges, and local taxes outside the European Union are the sole responsibility of the consumer.
  5. Duckie Wonderland is not liable for delays caused by customs authorities or transport carriers.

Article 6 — Right of Withdrawal (EU Consumers)

  1. In accordance with Directive 2011/83/EU, consumers have the right to withdraw from the contract within 14 days after receiving the product, without giving any reason.
  2. The consumer must return the goods within 14 days after exercising the right of withdrawal.
  3. Return shipping costs are borne entirely by the consumer.
  4. Standard outbound shipping costs will be refunded. If a more expensive delivery option was chosen, only the standard delivery costs will be refunded.
  5. Refunds will be processed within 14 days after receipt of the returned goods or proof of shipment.
  6. The consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
  7. The right of withdrawal does not apply to personalized or custom-made products.

Article 7 — Legal Warranty and Conformity

  1. In accordance with Directive (EU) 2019/771 on certain aspects concerning contracts for the sale of goods, consumers are entitled to goods that are in conformity with the contract.
  2. The statutory minimum two-year conformity guarantee applies within the European Union.
  3. This warranty does not cover damage caused by improper use, normal wear and tear, or external influences.

Article 8 — Product Safety and Use

  1. Unless explicitly stated otherwise, products are decorative collectible items.
  2. Products are not suitable for children under 3 years of age unless explicitly indicated.
  3. The consumer is responsible for safe and proper use of the product.

Article 9 — Limitation of Liability

  1. To the extent permitted by law, liability is limited to the amount paid for the relevant order.
  2. Duckie Wonderland shall not be liable for indirect damages, consequential damages, loss of profit, or business interruption.
  3. This limitation does not apply in cases of intent or gross negligence.

Article 10 — Intellectual Property

  1. All trademarks, designs, characters, logos, images, and concepts remain the exclusive property of Duckie Wonderland.
  2. Reproduction, distribution, or commercial exploitation without prior written permission is prohibited.
  3. Structural commercial resale without authorization may result in legal action.

Article 11 — Force Majeure

In the event of force majeure, including but not limited to production interruptions, transport disruptions, pandemics, supply chain failures, or governmental measures, Duckie Wonderland may suspend or terminate the agreement without liability.

Article 12 — Governing Law and Jurisdiction

  1. These Terms and all agreements are governed by Dutch law.
  2. Pursuant to Regulation (EC) No 593/2008 (Rome I), mandatory consumer protection provisions of the consumer's country of residence may apply.
  3. Disputes shall be submitted to the competent court in the Netherlands, unless mandatory consumer protection law provides otherwise.

Article 13 — Marketplace and Commercial Resale Restriction

  1. Products purchased via the webshop are intended for personal use by consumers.
  2. Structural or commercial resale of products, including but not limited to resale via online marketplaces (such as Amazon, eBay, Bol.com or similar platforms), physical retail stores, or professional distribution channels, is not permitted without prior written authorization from Duckie Wonderland.
  3. Duckie Wonderland reserves the right to:
    1. refuse or cancel orders reasonably suspected to be placed for unauthorized commercial resale;
    2. limit quantities per order;
    3. restrict future purchases in case of repeated violations.

This clause does not restrict the consumer's legal right to dispose of purchased goods in a private and incidental manner, in accordance with the principle of exhaustion of rights under EU law.

Article 14 — Collector's Variation Clause

  1. Many products offered by Duckie Wonderland are collectible items produced in limited or artistic production series.
  2. Minor variations in:
    1. color tone,
    2. finish,
    3. paint details,
    4. numbering sequence,
    5. packaging presentation,
    6. or other aesthetic characteristics
  3. may occur due to production processes, hand-finishing, material differences, or batch variations. Such minor variations do not constitute a lack of conformity within the meaning of Directive (EU) 2019/771, provided that the product remains consistent with its essential characteristics and intended decorative purpose.
  4. Where products are individually numbered, Duckie Wonderland does not guarantee delivery of a specific serial number unless explicitly agreed in writing.
